FDCPA Compliance

Our commitment to fair and legal debt collection practices

Our Commitment

UnpaidInvoice is committed to full compliance with the Fair Debt Collection Practices Act (FDCPA) and all applicable state and federal regulations governing debt collection. While our platform focuses on commercial/B2B debt collection, we apply FDCPA-level standards to all communications as a best practice.

Commercial Debt Only

The UnpaidInvoice Exposure Hub is exclusively for commercial/business debts. Consumer debts are prohibited from being publicly listed. All exposure requests undergo manual review by our team to ensure compliance before any listing goes live.

Communication Standards

All AI-generated communications through our platform adhere to the following standards:

  • Truthful and non-deceptive representations
  • Clear identification of the creditor and the debt
  • No threats of illegal action or false claims
  • Respect for debtor rights, including the right to dispute
  • Compliance with call time restrictions (8 AM - 9 PM local time)
  • Call recording disclosure at the start of every voice call
  • Mini-Miranda warnings included in all initial communications

Debtor Rights

Debtors listed on our platform have the right to:

  • Dispute the debt through our online dispute portal
  • Request verification of the debt
  • Pay a removal fee to have their listing removed from the Exposure Hub
  • Negotiate payment plans through our AI-powered chat system
  • Request cessation of communications

Audit Trail

Our platform maintains a comprehensive audit trail of all collection activities, including:

  • Every email, SMS, and voice call with timestamps

This audit trail can be exported as CSV for legal documentation purposes.
